The present Terms of Use and Purchase Conditions (hereinafter, "Conditions") establish the terms governing the use of this website (www.secretandyou.com) and the purchase of products on it.

We kindly ask you to read these Terms carefully, as well as our General Privacy Policy and Cookie Policy, both available on the website. These Terms may be modified, so it is your responsibility to read them periodically in order to know which ones are in effect at the time of your purchase. 1. INTRODUCTION

We inform you that BELMAR GLOBAL S.L. is the entity responsible for centralizing the marketing of Secret & You products. Thus, these Terms of Use and Purchase Conditions apply to the relationship between BELMAR GLOBAL S.L., (hereinafter, "Secret & You" or the "Company") and you (hereinafter, the "Client"), regarding all transactions you make on the website www.secretandyou.com (hereinafter, "Online Store").

BELMAR GLOBAL S.L., is a commercial entity of Spanish nationality, with its address at Sagunto Street, 4, CP 28290 Madrid (Spain), and CIF: B-88595541.

2. CUSTOMER DATA AND COMMITMENT

The information or personal data that the Customer provides us will be processed in accordance with the provisions of the General Privacy Policy of Secret & You, as well as the specific privacy policies of each web form.

By using this website, the Customer consents to the processing of their data and states that it is true and corresponds to reality. Therefore, the Customer agrees to:

• Use this website only to make legally valid inquiries or orders;
• Do not place any false or fraudulent orders. In case of any signs of falsehood or fraud, Secret & You is authorized to cancel the order and inform the relevant authorities. Furthermore, Secret & You does not assume any responsibility for any damages and/or expenses that may arise from this.
• Provide Secret & You with your email address (mail), postal address, and/or other contact details truthfully and accurately. Likewise, the Client agrees that Secret & You may use this information to contact you if necessary.
• Do not misuse this website by intentionally introducing viruses, trojans, worms, logic bombs, or any other technologically harmful or damaging programs or materials. The Customer shall not attempt to gain unauthorized access to this website, the server on which this page is hosted, or any server, computer, or database related to our website. Breaching this clause could result in the commission of offenses defined by the applicable regulations.

The Client declares to be over 18 (eighteen) years old and to have the legal capacity to enter into contracts. In this regard, Secret & You may verify, by means it deems appropriate, the fulfillment of the aforementioned requirement.

3. AVAILABILITY OF THE SERVICE AND PRODUCTS SECRET & YOU

The products offered on this website are available for the European territory (excluding Ceuta, Melilla, and the Canary Islands, as well as P.O. boxes). In the event that the Customer requests shipping outside the mentioned territory, Secret & You reserves the right not to accept and/or cancel the order.

All orders for Secret & You products are subject to availability. In case of supply difficulties or lack of stock, Secret & You will inform you via email and refund the Customer any amount that may have been paid.

4. ORDERS

How are orders placed?

To place an order, the Customer must follow the online purchasing procedure and click on the “CONFIRM ORDER” button. Subsequently, the Customer will receive an email acknowledging receipt of their order (“Order Confirmation”) within 24 hours. The Customer will also be informed via email that the order is being shipped (“Shipping Confirmation”). Additionally, the Customer can check the status of their order in “My Account” or by calling Customer Service.

In case the Customer has made a mistake when submitting their data, they can modify it in the "My Account" section; this data will apply to future purchases. If the error refers to the current order, the Customer must contact Customer Service.

How is shipping and delivery carried out?

At the moment the Customer makes the payment, Secret & You will ask them to choose the shipping method to carry out the delivery of their order. Shipping costs will vary depending on the chosen shipping method, being calculated automatically during the checkout process, and before finalizing the order.

Orders and payment confirmations received after 4:00 PM (local time) will be processed the next business day.

We offer the following shipping methods:

• Standard (3-5 business days) - €2.99. The delivery time for the order is 3 to 5 full business days, starting from the date of placing the order and payment of the corresponding price.
• Express (2 business days) - €5.99. The order will be delivered the next business day if placed before 4:00 PM the previous day or in two business days for orders placed after 4:00 PM.

*The prices shown only apply to shipments within the peninsula.

*Due to the high volume of orders during campaign periods (Black Friday, Christmas, etc.), delivery times may be delayed.

In the event that there are circumstances arising from the customization of the products, or unforeseen or extraordinary circumstances occur, Secret & You informs you that delivery times may be subject to changes.

If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option to proceed with the purchase, setting a new delivery date, or the possibility to cancel the order with a full refund of the price paid.

For the purposes of these Conditions, "delivery" will be understood to have occurred or that the order has been "delivered" at the moment when the Customer, or a third party indicated by them, takes physical possession of the products, which will be evidenced by the signature of the receipt of the order at the agreed delivery address.

In case of inability to deliver the order, it will be the user who will arrange the new delivery with the transport company.

Is it possible to check the order status and order history?

If the Customer has their own account at www.secretandyou.com, they can track their orders by visiting "My Account" and clicking on "View my orders". There, the Customer will be able to see the history of their orders, as well as their status.

In the event that the Customer is not registered and does not have the "My Account" section, they can directly contact the Customer Service of Secret & You to inquire about the status of their order.

Can Secret & You cancel an order?

Secret & You reserves the right to cancel any order (even if it has been previously accepted), and shall not be liable for any damage and/or expense in the following cases:

1. When an unintentional error has occurred in the online store; for example, a payment or stock error;
2. When there are reasons to believe that the Customer is underage or that the credit card to be used does not meet the requirements described in these Terms;
3. When the payment information provided by the Customer is incorrect or unverifiable.
4. When the shipping address provided by the Customer is outside the territory, or the order cannot be delivered to the address provided by the Customer.

In the event that any of these situations are identified, Secret & You will duly notify you via email, in order to resolve the issue before taking any action.

5. PRODUCT DISCONFORMITY

Once the order is received, it is advisable for the Customer to check its status and, in case of identifying any defect or discrepancy, they may choose to (i) return the product, and Secret & You will refund the corresponding purchase price, or (ii) replace the product with a new one in good condition, at no additional charge.

6. EXCHANGE AND/OR RETURN POLICY

i. Changes and Returns

If for any reason the Customer is not satisfied with the product purchased at www.secretandyou.com, you have up to 31 days to return it. During special times like Christmas, this period may be extended.

Secret & You will proceed to refund the full amount of the product price using the same payment method used by the Customer for the initial transaction. The refund will be made within 14 calendar days following the receipt of the merchandise at the Secret & You warehouses. Shipping and return costs, if applicable, will not be refunded. Shipping costs will only be refunded in the case that Secret & You has mistakenly delivered a different product or one with a defect.

The method that Secret & You establishes for the returns of its products is:

A carrier can pick up the product to be returned at the address chosen by the Customer (applicable exclusively within the Spanish mainland territory and the Balearic Islands. Excludes Canary Islands, Ceuta, and Melilla).

The items to be returned must be delivered with their corresponding delivery note and the certificate of authenticity. Additionally, if the Customer chooses this option, Secret & You recommends keeping the courier's receipt as proof of the return made.

ii. Right of withdrawal

The Customer has the right to withdraw from this contract within 14 (fourteen) calendar days without the need for any justification.
To exercise the right of withdrawal, the Customer must notify Secret & You of the decision to withdraw from the contract through an unequivocal statement and by the following means:

Consequences of withdrawal

In the event of withdrawal, Secret & You will refund the Customer all payments received after the purchase, including shipping costs (except for additional costs resulting from the Customer's choice of a delivery method other than the least expensive standard delivery option we offer), without any undue delay and, in any case, no later than 14 calendar days from the date we are informed of the decision to withdraw from this contract.

Secret & You will proceed to issue the refund using the same payment method employed by the Customer for the initial transaction.

Secret & You may withhold the refund until the products have been received, or until proof of their return has been provided.

The Customer must return or deliver the goods directly without any undue delay and, in any case, no later than 14 calendar days from the date they communicate their decision to withdraw from the contract.

The return will be made under the responsibility and expense of the buyer, attaching the purchase receipt and the corresponding certificate of authenticity. The item must be in perfect condition and in its original packaging.

In the event that you exercise the right of withdrawal, you will only be responsible for the decrease in value of the products resulting from handling them in a way that is different from what is necessary to establish their nature, characteristics, or functioning.

7. SHOP AS GUEST

The Secret & You website also allows purchases through the guest checkout feature. In this purchasing mode, only the essential information needed to process the order will be requested from the Customer.

Once the purchase process is completed, the Customer will be given the option to register as a user or continue as an unregistered user.

8. PRICES AND TAXES

The prices of the products displayed on the website are the ones that apply at the time of purchase. Prices may be subject to change without prior notice, but this will not affect orders that have already been accepted.

All product prices, shipping costs, and other services include VAT. Shipping costs are added per order. Secret & You will always inform you of the total price, including all taxes and other costs such as fees and possible delivery charges.

The Client expressly authorizes Secret & You to issue the invoice in electronic format, although they may inform us at any time of their desire to receive a paper invoice, in which case we will issue and send the invoice in that format.

During the checkout process, the Customer's credit card identification number (CVV) is required. The CVV is a 3 or 4 digit numerical value that provides an encryption control of the information recorded on the card. This security feature is designed to protect the Customer against fraud. Your CVV will not be stored in our systems, and the Customer will need to provide the number each time they make a purchase at www.secretandyou.com.

When the purchase request and the Customer's data have been verified, and the purchased products have left the Secret & You warehouse for shipping, the charge for the price will be processed from your account.

When the Customer clicks on "AUTHORIZE PAYMENT," they confirm that the credit card is theirs or that they are its legitimate holder. Credit cards will be subject to checks and authorizations by the issuing entity, but if that entity does not authorize the payment, Secret & You will not be responsible for any delays or lack of delivery and will not be able to formalize any contract with the Customer.

10. COUNTERFEIT ALERT

The Secret & You products are available exclusively on the Secret & You website (www.secretandyou.com) and in the Secret & You Amazon store. Buyers should be cautious of products that may be sold through unauthorized channels. To avoid confusion, when purchasing at any authorized establishment, a certificate of authenticity is issued, certifying the legitimacy of the product and its validity regarding any production imperfections.

Since its foundation in 2016, Secret & You has strived to ensure high standards of quality in all its products. All products from Secret & You bear the seal of noble metals: 18 kt Gold (750/000) and Sterling Silver (925/000).

12. COMPANY LIABILITY

Secret & You guarantees the quality of the service contracted through the Online Store.

All rights granted to consumers and users by current laws are guaranteed.

The breach of any of these Terms and Conditions may result in the return of products or the cancellation of services purchased by the Customer.

13. WARRANTIES

Secret & You will respond to the Customer for any non-conformity expressed in the deliveries, within a period of two years, as established by current regulations. The warranty does not cover damages caused by use or improper use, as well as all those generally excluded by current legislation.

Unless expressly provided otherwise in these Terms, Secret & You's liability in relation to any product purchased on the website shall be strictly limited to the purchase price of that product.

All descriptions, product photographs, information, and materials on this website are provided "as is" and without any express or implied warranties, except as legally established. Some products may appear slightly larger or smaller than their actual size due to screen settings and photographic techniques. Other items may be represented in a larger size than their actual size to clearly show details, or smaller than their actual size to display the entire item. In this regard, if the Customer contracts as a consumer and user, Secret & You is obligated to deliver items that are in accordance with the contract, being liable to the Customer for any lack of conformity that exists at the time of product delivery. Additionally, the color shades in the photographs of the products in the online store may be altered by your monitor's resolution, potentially differing from the actual colors.

The products we sell may exhibit some variations due to the inherent characteristics of the natural materials used in their manufacture. These characteristics, such as variations in colors, sizes, textures, among others, will not be considered defects or flaws.

Secret & You shall not be liable for any damage or loss resulting from a denial-of-service attack, virus, or any other technologically harmful or damaging program or material that may affect the Customer's computer, computer equipment, data, or materials as a result of using this website or downloading content from it or, where applicable, to which it redirects.

14. FORCE MAJEURE

Secret & You shall not be liable for any breach or delay in the performance of any of its obligations when such breach or delay is due to events beyond reasonable control ("Force Majeure").

The Causes of Force Majeure will include any act, event, lack of exercise, omission, or accident that is beyond our reasonable control and, among others, the following:

• Strikes, employer lockouts, or other protest measures.
• Civil commotion, uprising, invasion, threat or terrorist attack, war (declared or not) or threat or preparations for war.
• Fire, explosion, storm, flood, earthquake, sinking, epidemic, or any other natural disaster.
• Inability to use trains, boats, airplanes, motor transport, or other means of transportation, public or private.
• Inability to use public or private telecommunications systems.
• Acts, decrees, legislation, regulations, or restrictions from any government or public authority.

It will be understood that the obligations will be suspended during the period in which the "Force Majeure Cause" continues, and Secret & You will have an extension of the deadline to fulfill these obligations for a period equal to the duration of the "Force Majeure Cause." Secret & You will make all reasonable efforts to bring the "Force Majeure Cause" to an end, or to find a solution that allows it to fulfill its obligations despite the "Force Majeure Cause."

15. INDUSTRIAL AND INTELLECTUAL PROPERTY

The Client acknowledges and agrees that all copyright, trademark, and other industrial and intellectual property rights over all the content of the website belong to Secret & You, or to those who granted Secret & You a license for its use.

16. PREVENTION OF MONEY LAUNDERING AND TERRORISM FINANCING

Secret & You, due to its professional marketing activity of jewelry, precious stones, or metals, is subject to Law 10/2010 of April 28, on the prevention of money laundering and the financing of terrorism.

This means that, among other obligations applicable to this condition, Secret & You must identify and keep a copy of the valid identity document (ID card, Passport, etc.) of any customer who makes a purchase equal to or greater than €1,000 in jewelry products. This is in accordance with the current regulations on the matter.

Thus, the Client is aware of this legal obligation and agrees to send, at the request of Secret & You, a copy of the valid identity document to comply with it within a maximum period of ONE MONTH from the date of purchase.

17. WRITTEN COMMUNICATIONS

The applicable regulations require that part of the information or communications sent by Secret & You be in writing. The Client, by using this website, consents to most of such communications with Secret & You being electronic.

Thus, Secret & You will contact the Customer via email or by posting notices on the website itself. For contractual purposes, the Customer consents to use this electronic means of communication and acknowledges the fulfillment of the legal requirement to be in writing.

18. ASSIGNMENT OF RIGHTS AND OBLIGATIONS

The contract is binding for both the Client and Secret & You, as well as for their respective successors, assignees, and heirs. The Client may not transfer, assign, encumber, or otherwise transfer a contract or any of the rights or obligations arising from it, without having obtained the prior written consent of Secret & You.

We can transmit, assign, encumber, subcontract, or in any other way transfer a contract or any of the rights or obligations arising from it, at any time during its validity, without affecting the rights of the Customer in any way.

19. WAIVER

The lack of requirement by Secret & You regarding the strict compliance with any of the obligations assumed by the Client, under a contract or these Conditions, or the lack of exercise by Secret & You of the rights or actions that may correspond to it, under said contract or the Conditions, shall not imply waiver or limitation in relation to such rights or actions, nor shall it exempt the Client from fulfilling such obligations.

No waiver by Secret & You of any specific right or action shall constitute a waiver of other rights or actions arising from a contract or the Terms.

No waiver by Secret & You of any of the present Conditions or of the rights or actions derived from a contract shall be effective unless expressly stated to be a waiver, formalized, and communicated to the Customer in writing as provided above.

20. COMPLETE AGREEMENT AND PARTIAL NULLITY

These Conditions, and any document expressly referred to herein, constitute the entire agreement between the Customer and Secret & You regarding the subject matter hereof. They also replace any other pact, agreement, or promise previously made between the Customer and Secret & You, whether verbally or in writing.

The Client and Secret & You acknowledge having consented to the conclusion of a contract without relying on any statement or promise made by the other party or that could be inferred from any statement or writing in the negotiations held by both prior to it, except for what is expressly mentioned in these Terms.

Neither the Client nor Secret & You have any action against any uncertain statement made by the other party, whether verbal or written, prior to the date of a contract (unless such uncertain statement was made fraudulently) and the only action available to the other party will be for breach of contract, in accordance with the provisions of these Terms.

If any of these Conditions or any provision of a contract are declared null and void by a final ruling issued by a competent authority, the remaining terms and conditions shall remain in effect, without being affected by such declaration of nullity.

21. MODIFICATION OF CONDITIONS

Secret & You reserves the right to review and modify these Terms at any time.
The Customer will be subject to the policies and Conditions in effect at the time they use this website or place each order.

22. LANGUAGE, APPLICABLE LEGISLATION AND JURISDICTION

The language in which the contract between Secret & You and the Client will be perfected is Spanish.

The use of the Secret & You website and the purchase contracts for products through said website will be governed by Spanish law.

Any controversy that arises or relates to the use of the website or to such contracts will be submitted to the non-exclusive jurisdiction of the courts and tribunals of the Client's domicile.
