These Conditions may be modified, so it is your responsibility to read them periodically in order to know those that are in force at the time of making your purchase. Thus, these Terms of Use and Purchase Conditions are applicable to the relationship between BELMAR GLOBAL S. L , (hereinafter, “Secret & You” or the “Company”) and you. (hereinafter, the "Customer"), regarding all those transactions that you carry out on the website www. secretandyou. com (hereinafter, “Online Store”).

2. DATA AND CLIENT COMMITMENT
The information or personal data that the Client provides us will be treated in accordance with the provisions of the General Privacy Policy of Secret & You, as well as in the specific Privacy Policies of each web form.
By using this website, the Client consents to the processing of their data and declares that they are true and that they correspond to reality. Therefore, the Client agrees to:
- Use this website only to make legally valid inquiries or orders;
- Not place any false or fraudulent orders. In case of evidence of falsehood or fraud, Secret & You is authorized to cancel the order and inform the relevant authorities. Likewise, Secret & You does not assume any type of responsibility for the damages and/or expenses that may arise from it.
- Provide Secret & You with your email address, postal address and/or other contact information in a truthful and exact manner. Likewise, the Client confirms that Secret & You can make use of said information to contact him, if necessary.
- Not make improper use of this website by intentionally introducing viruses, Trojan horses, worms, logic bombs or any other program or technologically harmful material. The Client will not try to gain unauthorized access to this web page, to the server on which said page is hosted or to any server, computer or database related to our web page. Failure to comply with this clause could lead to the commission of offenses typified by the applicable regulations.
The Client declares to be over 18 (eighteen) years of age and to have the legal capacity to enter into contracts. In this sense, Secret & You will be able to verify, through the means it deems appropriate, compliance with the aforementioned requirement.
3. AVAILABILITY OF THE SECRET & YOU SERVICE AND PRODUCTS
The products offered on this website are available for the European territory (excluding Ceuta, Melilla and the Canary Islands, as well as post office boxes). In the event that the Client requests its shipment outside the aforementioned territory, Secret & You reserves the right not to accept and/or cancel the order.
All orders for Secret & You products are subject to product availability. In the event of supply difficulties or in the event of a lack of stock, Secret & You will notify you by email and will reimburse the Customer for any amount that may have been paid.
4. ORDERS
How are orders placed?
To place an order, the Customer must follow the online purchase procedure and click on the "CONFIRM ORDER" button. Subsequently, the Client will receive an email acknowledging receipt of his order ("Order Confirmation") within 24 hours of the order. The Client will also be informed, by email, that the order is being shipped (“Shipping Confirmation”). Likewise, the Client can check the status of his order in "My Account" or by calling the Customer Service.
In the event that the Client has made a mistake when sending his data, he can modify them in the "My Account" Section; Said data will be applicable for future purchases. In the event that the error refers to the order in progress, the Customer must contact Customer Service.
How is shipping and delivery done?
At the time the Customer makes the payment, Secret & You will ask him to choose the shipping method to be able to carry out the delivery of his order. The shipping costs will vary depending on the chosen shipping method, being computed automatically during the payment process, and before finalizing the order.
Orders and payment confirmations received after 4:00 p.m. (local time) will be processed the next business day.
We have the following shipping methods:
- Standard (3-5 working days) - €2.99. The delivery time of the order is from 3 to 5 full working days, counting from the date of placing the order and payment of the corresponding price.
- Express (2 business days) - €5.99. The order will be delivered the next business day if it was placed before 4:00 p.m. the day before or in two business days for orders after 4:00 p.m.
*The prices shown only correspond to shipments in the peninsula.
*Due to the high volume of orders during campaign periods (Black Friday, Christmas, etc. ) delivery times may be delayed.
In the event that there are circumstances derived from the personalization of the products, or unforeseen or extraordinary circumstances occur, Secret & You informs you that delivery times may be subject to variations.
If for any reason we could not meet the delivery date, we will inform you of this circumstance and we will give you the option to continue with the purchase, establishing a new delivery date, or the possibility of canceling the order with the refund full price paid.
For the purposes of these Conditions, the "delivery" shall be deemed to have occurred or that the order has been "delivered" at the time the Customer, or a third party indicated by the Customer, acquires material possession of the products , which will be accredited by signing the receipt of the order at the agreed delivery address.
In case of impossibility at the time of delivery of the order, it will be the user who will agree with the transport company the new delivery.
Is it possible to check the order status and order history?
If the Client has his own account at www. secretandyou. com, you can track your orders by visiting "My Account" and clicking "View My Orders". There, the Client will be able to see the history of their orders, as well as their status.
In the event that the Customer is not registered and does not have the "My Account" space, they can contact Secret & You Customer Service directly to be informed about the status of their order.
Can Secret & You cancel an order?
Secret & You reserves the right to cancel any order (even if it has been previously accepted), not being responsible for any damage and/or expense, in the following cases:
- When an involuntary error has occurred in the online store; for example a payment or stock error;
- When there are reasons to believe that the Customer is a minor or that the credit card to be used does not meet the requirements described in these Conditions;
- When the payment information provided by the Customer is incorrect or unverifiable.
- When the shipping address provided by the Customer is outside the territory, or the order cannot be delivered to the address provided by the Customer.
In the event of any of these assumptions being identified, Secret & You will duly notify you via email, in order to be able to resolve the problem before carrying out any action.
5. PRODUCT NONCONFORMITY
Once the order is received, it is recommended that the Client check the status of the order and, in the event of identifying any defect or non-conformity, he may choose to (i) return the product, and that Secret & You refund the price of corresponding purchase, or (ii) replace the product with a new one in good condition, without additional charges.
6. CHANGES AND/OR RETURNS POLICY
i. Changes and returns
If for any reason the Customer is not satisfied with the product purchased at www. secretandyou. com, you have up to 31 days to return it. In special times like Christmas, this period can be extended.
Secret & You will proceed to refund the full amount of the price of the product using the same means of payment used by the Client for the initial transaction. The refund will be made within 14 calendar days following receipt of the merchandise at the Secret & You warehouses. Shipping or return costs, if applicable, will not be refunded. Shipping costs will only be refunded in the event that Secret & You has delivered a different product by mistake, or with a defect.
The method that Secret & You establishes for the returns of its products are:
A carrier can pick up the product to be returned at the address chosen by the Customer (applicable exclusively within the Spanish mainland and the Balearic Islands. The Canary Islands, Ceuta and Melilla are excluded).
The items to be returned must be delivered with their corresponding delivery note and the certificate of authenticity. Likewise, if the Client chooses this alternative, Secret & You recommends that they keep the courier's receipt as proof of the return made.
ii. Right of withdrawal
The Client has the right to withdraw from this contract within a period of 14 (fourteen) calendar days without the need for any justification.
To exercise the right of withdrawal, it is necessary for the Client to notify Secret & You of the decision to withdraw from the contract, through an unequivocal statement and by the following means:

Consequences of withdrawal
In the event of withdrawal, Secret & You will return to the Customer all payments received after the purchase, including shipping costs (with the exception of additional costs resulting from the choice by the Customer of a delivery method other than the one least expensive modality of ordinary delivery that we offer), without any undue delay and, in any case, no later than 14 calendar days, counting from the date on which you inform us of the decision to withdraw from this contract.
Secret & You will proceed to make said refund using the same means of payment used by the Client for the initial transaction.
Secret & You may withhold the refund until you have received the products, or until you have presented proof of their return.
The Client must directly return or deliver the goods without undue delay and, in any case, no later than 14 calendar days from the date on which he communicates his decision to withdraw from the contract.

Said return will be made under the responsibility and expense of the buyer, attaching the purchase receipt and the corresponding certificate of authenticity. The piece must be in perfect condition and in its original packaging.
In the event that you exercise the right of withdrawal, you will only be responsible for the decrease in value of the products resulting from handling them other than that necessary to establish their nature, characteristics or operation.

7. SHOP AS A GUEST
The Secret & You website also allows purchase through the guest purchase functionality. In this mode of purchase, the Client will be requested only the essential data to be able to process his order
Once the purchase process is complete, the Client will be offered the possibility of registering as a user or continuing as a non-registered user.
8. PRICES AND TAXES
The prices of the products that appear on the website are those that apply at the time of purchase. Prices may be subject to change without notice, but will not affect orders that have already been accepted
All product prices, shipping costs and other services include VAT. Shipping costs are added per order. Secret & You will always report the total price, including all taxes and other costs such as fees and possible delivery charges.

During the purchase process, the Customer's credit card identification number (CVV) is required. When the purchase request and the Customer's data have been verified, and the purchased products have left the Secret & You warehouse, for shipping, the price charge will be made from your account.
When the Client clicks on "AUTHORIZE PAYMENT", he confirms that the credit card is his or is his legitimate holder. Credit cards will be subject to checks and authorizations by the issuing entity, but if said entity does not authorize the payment, Secret & You will not be responsible for any delay or non-delivery and will not be able to formalize any contract with the client.

Buyers should beware of products that may be sold through unauthorized channels. All the rights that the Laws in force attribute to consumers and users are guaranteed.
Breach of any of these Terms and Conditions may lead to the return of the products or the cancellation of the services purchased by the Customer.
13. GUARANTEES
Secret & You will respond to the Client for any lack of conformity manifested by the deliveries, within a period of two years, as established by current regulations. The guarantee related to those damages caused by use or improper use is excluded, as well as in general all those excluded by current legislation.
Except as otherwise expressly provided in these Conditions, Secret & You's liability in relation to any product purchased on the website will be strictly limited to the purchase price of said product.
All the descriptions, photographs of products, information and materials that appear on this web page are provided "as true body" and without express or implicit guarantees on them except those established by law. Some products may appear slightly larger or smaller than actual size due to display settings and photographic technique. 14. FORCE MAJEURE

- Acts, decrees, legislation, regulations or restrictions of any government or public authority.
It will be understood that the obligations will be suspended during the period in which the "Cause of Force Majeure" continues, and Secret & You will have an extension of the term to comply with said obligations for a period of time equal to the duration of the "Cause of Force Majeure”. Secret & You will put all reasonable means to end the "Cause of Force Majeure", or to find a solution that allows it to comply with its obligations despite the "Cause of Force Majeure".
15. INDUSTRIAL AND INTELLECTUAL PROPERTY
The Client acknowledges and agrees that all copyright, trademark and other industrial and intellectual property rights on all the contents of the website correspond to Secret & You, or to those who granted Secret & You a license for its use.
Secret & You, due to its professional sale of jewellery, stones or precious metals, is a subject bound by Law 10/2010 of April 28, on the prevention of money laundering and terrorist financing.
This means that, among other obligations that are applicable to said condition, Secret & You must identify and keep a copy of the authentic identity document (DNI, Passport, etc. ) of any customer who makes a purchase equal to or greater than 1. €000 in jewelry products. This is due to the provisions of current regulations on the matter.
Thus, the Client is aware of this legal obligation and undertakes to send, at the request of Secret & You, a copy of the authentic identity document to comply with it within a maximum period of ONE MONTH from the completion of the the purchase.
The applicable regulations require that part of the information or communications sent by Secret & You be in writing. The Client, with the use of this web page, consents that most of said communications with Secret & You are electronic.
Thus, Secret & You will contact the Client by email or posting notices on the website itself. For contractual purposes, the Client agrees to use this electronic means of communication and acknowledges compliance with the legal requirement to be in writing.
18. ASSIGNMENT OF RIGHTS AND OBLIGATIONS
The contract is binding on both the Client and Secret & You, as well as their respective successors, assigns and assigns. The Client may not transmit, assign, encumber or, in any other way, transfer a contract or any of the rights or obligations derived from it, without having obtained the prior written consent of Secret & You.

No waiver by Secret & You of a specific right or action will imply a waiver of other rights or actions derived from a contract or the Conditions.
No waiver by Secret & You of any of these Conditions or of the rights or actions derived from a contract will take effect, unless it is expressly established that it is a waiver, and it is formalized and communicated to the Client in writing in accordance with the provisions above.
20. COMPLETE AGREEMENT AND PARTIAL NULLITY
These Conditions, and any document to which express reference is made in them, constitutes the entire agreement existing between the Client and Secret & You, in relation to the object thereof. Likewise, they supersede any other prior covenant, agreement or promise agreed between the Client and Secret & You verbally or in writing.
The Client and Secret & You acknowledge having consented to the conclusion of a contract without having relied on any statement or promise made by the other party or that could be inferred from any statement or writing in the negotiations entered into by the two before it, except for what is expressly mentioned in these Conditions.
Neither the Client nor Secret & You have an action against any uncertain statement made by the other party, verbal or written, prior to the date of a contract (unless such uncertain statement had been made fraudulently) and the only action available to the other party will be for breach of contract, in accordance with the provisions of these Conditions.
If any of these Conditions or any provision of a contract were declared null and void by a final resolution issued by a competent authority, the remaining terms and conditions will remain in force, without being affected by said declaration of nullity.
21. MODIFICATION OF CONDITIONS
Secret & You reserves the right to revise and modify these Conditions at any time.
The Customer will be subject to the policies and Conditions in force at the time they use this website or make each order.
22. LANGUAGE, APPLICABLE LAW AND JURISDICTION
The language in which the contract between Secret & You and the Client will be perfected is Spanish.

Any controversy that arises or is related to the use of the website or with said contracts will be submitted to the non-exclusive jurisdiction of the courts and tribunals of the Client's domicile.
